Besigye Must Walk Free — By Court Order or Political Deal?

Veteran opposition figure Dr. Kizza Besigye remains in Luzira Maximum Security Prison in deteriorating health, more than a year after his arrest, fueling renewed debate over how he should regain his freedom  through a courtroom victory or a political agreement  as his wife accuses powerful figures of manipulating the justice system.

Besigye was arrested on November 16, 2024 in Nairobi, Kenya, and brought to Uganda where he was charged with treason and other offences related to an alleged plot to overthrow the government. The prosecution claims his travels and meetings in Europe and Africa between 2023 and 2024 were part of a conspiracy, charges the opposition rejects as politically motivated.

His detention, initially in a military court, sparked fierce legal and civil rights objections, particularly after the Supreme Court ruled that civilians should not be tried in military tribunals. Despite this, Besigye remains behind bars, intensifying calls for justice from opposition figures, lawyers, activists and international observers.

Wife’s Sharp Words to Muhoozi
In a blistering recent statement, Winnie Byanyima, Besigye’s wife and executive director of UNAIDS, charged President Yoweri Museveni and his son Gen. Muhoozi Kainerugaba with engineering her husband’s detention and trial. Byanyima described the proceedings as a “travesty of justice” and accused the military court of being controlled by the government’s most powerful figures. In a forceful message, she vowed to “honourably bury” Besigye as a “true Ugandan and African hero,” signaling her deep mistrust of the process and her belief that political interference, not law, is determining his fate.

Besigye’s health has worsened significantly behind bars. Byanyima told reporters that he suffers from high fever, dehydration and leg pain, and prison authorities have refused to transfer him to a private clinic despite medical recommendations — a development that has alarmed human rights groups and doctors alike.

Paths to Freedom: Court or Political Deal?
With his treason case lingering and legal avenues proving slow and fraught, two main options have emerged in public debate on how Besigye might regain his liberty:

Court Order:
Legal teams continue to push for Besigye’s unconditional release, arguing that the Supreme Court’s judgment against civilian trials in military courts should apply to his case and free him. Supporters call on civilian courts to assert their authority and declare his continued detention unlawful.

Political Agreement:
Some opposition leaders suggest a negotiated political settlement between the ruling government and opposition forces could secure his freedom outside the courtroom. They argue that only a broader pact that addresses political grievances ahead of future elections can end the cycle of arrests of opposition figures.

Public Reaction
Reactions across civil society have been mixed but increasingly vocal. Opposition rallies, legal protests and petitions have called for Besigye’s release, while government supporters insist the charges are legitimate and that the justice system, including military courts, must run its course. International human rights groups have also criticized Besigye’s treatment as part of a broader crackdown on dissent.

As the 2026 general election cycle progresses and political tensions remain high, the debate over how Besigye should leave prison — by legal vindication or negotiated agreement — underscores deep divisions in Uganda’s governance and justice landscape.
